Legal Credit Repair Methods

Before we talk about legal credit report repair, let's take a look at different  types of illegal credit repair:

  • Illegal: You can't change your social security number to obtain new credit.
    If any company should suggest this type of credit repair, report them to the authorities.

  • Illegal: You can't dispute every item on your credit report, regardless of nature.
    The Fair Credit Reporting Act specifically states that only items that are unverifiable, inaccurate or misleading should be disputed. Any negative items that really are yours, and are a true reflection of your credit history should not be disputed.

  • Illegal: You can't be charged for services that have not yet been completed. This is to protect the consumer from fraudulent companies that charge "Up Front" fees for services that never get completed (for instance if you paid them money before they performed any service then you never heard from them again.)

So, What the Heck is Legal Credit Repair?

Legal Credit Repair involves removing negative items on a credit report. These are items  that are inaccurate or unverified. There are a many different ways of doing this. Here are some of the most common and effective ways:

Goodwill Negotiation

This approach deals with negotiating directly with creditors. They are sent a written letter asking  them to "please" remove negative items from your bad credit reports. This an effective method of credit repair for mild late-pay accounts. There are no laws that require that negative items stay on your reports for any specific period of time. Creditors have the choice of simply removing these items from your credit report.

Credit Disputation

The Fair Credit Reporting Act gives you the right to contact credit bureaus by directly. You can do this by  writing credit repair letters and dispute items on your credit reports. Just as in a court of law, you have the right to plead "not guilty" to negative information on your credit reports. You leave the burden of proof to the credit bureaus. You can dispute any and all items on your credit reports that you feel classify as inaccurate, unverifiable, or misleading. If the bureaus can not verify that the information on your reports is indeed correct, then those items must be deleted.

Despite all the controversy surrounding the credit repair report industry, credit repair is perfectly legal. That point is solidified by the creation of the CROA.

How to Deal With an Interview When You Have a Low Credit Score

Because today's jobless rate is almost 10%, of  borrowers are not paying their obligations on time. This is typically what happens: You don't have revenue coming in so you depend more on borrowing from credit cards. When you get behind on making payments, bill collectors increase the interest rate and decrease the amount you can borrow. Consequently that causes your credit rating to decline. The end effect is that it is very difficult to get a job.

The reason credit checks are done is that businesses want to identify any security risks before they make a hiring decision. For example, the reasoning is that an individual who is financially unstable may be at a higher risk of stealing money from the company. Companies evaluate FICO scores using this scale: lower than 700 = warning, underneath 650 = concern, and lower than than 600 is a red flag warning.

Several businesses try to ignore credit ratings but some places like banks and other financial institutions are not so open-minded. If you are trying to get a city, state, or federal job, you can expect to have a credit and background check done.

What can you do when you have a low credit score?

  1. Learn what your rights are. Businesses are legally bound to get your consent to do a credit or background investigation. And they have to tell you if you were not given the job because of your bad credit score. They also have to tell you which credit reporting agency they contacted to check your credit. The Government introduced H.R. 3149 in July of 2009 which is a bill meant to stop companies from doing credit investigations on possible employees.   2. Before you send in a resume for a job get a copy of your credit report. Make sure you check your credit report for inaccurate or erroneous information.

  3. Be sincere and truthful with possible employers. When the subject comes up, advise the interviewer what you have done to improve your credit score. That proves that you are responsible and a "get it done" kind of person.

  4. Do what it takes to fix your credit report as quickly as possible. Question any erroneous or derogatory remarks with the appropriate credit reporting agency. There are legal Credit Repair Report businesses that can do credit repair for you.

Here are some things you can do to improve your credit rating:

  • Get your payments current.

  • If you are already behind on obligations, call your banker and negotiate some kind of repayment plan.

  • Don't stop paying your bills -- make the ones in collection your priority.

  • If you make your payments on time for two months in a row, you can increase your credit score by 20 or 30 points.

  • Use a reputable credit repair company. You can usually see negative and derogative remarks start coming off of your credit report and an improved credit score within 45 days.
